Question by Learn2bstill: Looking for some legal advice from lawyers or law firms?
I am looking into doing some online training in the area of paralegal studies. I am planning on making a career change and want to go in the paralegal direction.

Can any lawyers or law firms tell me what they look for from a paralegal. Are they looking for an AA, a BA, a paralegal certificate (like the 14 week course Boston University offers), or otherwise?

Also……..what do you think about the NALA? Is it beneficial/necessary to take the CLA examination that they offer?

Can you please tell me your sources with web addresses if possible

The term “paralegal” is actually pretty broad, and covers the spectrum from what is basically an office assistant all the way to someone who handles substantive legal work.

The more legal education you have, the better your chances of being hired, and the more interesting work you’ll eventually end up doing. Generally, most large firms or corporations are going to want someone with at least an Assocaite’s degree. If you already have an undergrad degree, many programs will allow you to transfer credits, and do what’s effectively a 6-month or one-year program and get another undergrad degree.

As far as national certifications (CLA) or professional associations (NALA, etc.) those are mainly resume boosters. Local paralegal associations are good for networking, and finding job openings. National associations are good for continuing legal education (required in a few states) and general guidance.

I don’t know about BU, but I know that Hesser College has a good paralegal progam based out of the Nashua and Salem (NH) campuses. NALA and the National Federation of Paralegals also list many programs on their websites.

Question by Alison L: Need family law legal advice please regarding house title in event of divorce or death?
My mother put down a huge downpayment for my husband and I to buy a home. The house is only in my and my husband’s names, so there is no proof that she gave us that money. We put in writing (a typed up 3 page document) that if we were to divorce or I die, that my mother becomes the owner of the house since she put 6 figures down on it. My husband signed it, and a girl at the bank notarized it-the last, third page of it anyway. If I were to die or we get divorced, will those papers that we created and signed hold up in court, or would we need a lawyer to draw up more official papers? Or is there something even better that we could do that I have not listed??

At the very least, you should have a lawyer review the document you signed to see if it will hold up under the circumstances that concern you.

Question by Curtis Jones: In BC is it legal for an employer to prohibit romantic relationships? What are the competing legal rights?
What laws, regulations, legal principles are involved for human resources/employers, with regard to prohibiting workplace romantic relationships in BC/Canada? Also what recourse do employees have, are they protecting in any way from having an employer deny their right to date a coworker?

There are no competing legal rights.

You are always welcome to leave your job and then date a previous coworker. Or the coworker is welcome to leave their job and then date you.

The Canadian Charter does not provide you a right to date a coworker despite your belief that it is your right.

Tax, what does it all mean?

To tax (from the Latin taxo; "I estimate") is to impose a financial charge or other levy upon a taxpayer (an individual or legal entity) by a state or the functional equivalent of a state such that failure to pay is punishable by law.

Taxes are also imposed by many subnational entities. Taxes consist of direct tax or indirect tax, and may be paid in money or as its labour equivalent (often but not always unpaid labour). A tax may be defined as a "pecuniary burden laid upon individuals or property owners to support the government […] a payment exacted by legislative authority."[1] A tax "is not a voluntary payment or donation, but an enforced contribution, exacted pursuant to legislative authority" and is "any contribution imposed by government […] whether under the name of toll, tribute, tallage, gabel, impost, duty, custom, excise, subsidy, aid, supply, or other name."

The legal definition and the economic definition of taxes differ in that economists do not consider many transfers to governments to be taxes. For example, some transfers to the public sector are comparable to prices. Examples include tuition at public universities and fees for utilities provided by local governments. Governments also obtain resources by creating money (e.g., printing bills and minting coins), through voluntary gifts (e.g., contributions to public universities and museums),by imposing penalties (e.g., traffic fines), by borrowing, and by confiscating wealth. From the view of economists, a tax is a non-penal, yet compulsory transfer of resources from the private to the public sector levied on a basis of predetermined criteria and without reference to specific benefit received.

In modern taxation systems, taxes are levied in money, but in-kind and corvée taxation are characteristic of traditional or pre-capitalist states and their functional equivalents. The method of taxation and the government expenditure of taxes raised is often highly debated in politics and economics. Tax collection is performed by a government agency such as Canada Revenue Agency, the Internal Revenue Service (IRS) in the United States, or Her Majesty’s Revenue and Customs (HMRC) in the UK. When taxes are not fully paid, civil penalties (such as fines or forfeiture) or criminal penalties (such as incarceration) may be imposed on the non-paying entity or individual.
