Question by Off: what legal action can you take against a company that doesnt give you two paid 15 minute breaks for 9 hr shift?
In New York. I worked for a retail company that didn’t give their employees 15 minute paid breaks for long shifts (9-10 hours) Do you call human resources? Is there anything they can do to help ?

  1. my 2 cents Says:

You have to find out the state labor laws for New York. Most states do NOT require paid 15 minute breaks on top of meal breaks.

  2. Janet Pierce Says:

If you work at least 6 hours starting before 11am and ending after 2pm you must be given an UNINTERRUPTED, UNPAID, 30 min lunch. No breaks required.

  3. Teekno Says:

You can quit and go to another company. In New York, like most states, there’s no legal requirement for an employer to give you breaks (other than unpaid meal breaks).
